Personnel Compliance

Smaller businesses often have no special department to deal with such issues, and leave the other areas of the company to handle them in addition to their day-to-day business. One such issue is ensuring the employees’ correct behaviour in conformance with regulations and corporate policies.
How can a company or organization make sure that its employees act in accordance with the applicable rules and regulations, especially under such difficult conditions? And which rules, regulations and laws are applicable in the given workplace? The certificate programme in Personnel Compliance focuses on how organizations can avoid sanctions and other losses by ensuring that everyone adheres to regulations and corporate policies, and on how those responsible for personnel can respond appropriately in case of conflicts and violations by their employees.
This programme deals with issues of ethics, labour law and criminal law and teaches you the necessary skills to meet all challenges connected with personnel compliance efficiently and effectively.
The Personnel Compliance certificate programme gives you an overview of the complex requirements that labour law places on you as well as on your employees, enables you to classify violations of criminal law such as corruption, and equips you with the skills to solve potential conflicts appropriately.
Learning Outcomes
The certificate programme in Personnel Compliance enables you to implement and enforce company and personnel decisions in compliance with applicable regulations. Beginning with ethical principles that you will learn to integrate as important foundations of your personnel management, you will be able to outline the restrictions that labour law places on the implementation of compliance processes. Moreover, you will be able to ensure constant, sustainable conformance with the conditions and requirements of labour law. You will be able to answer specific legal questions, such as questions involving insider knowledge or whistle-blowing, as they relate to your professional practice. You will also be able to implement personnel information systems that are adapted to the requirements of company-wide compliance. In this way you will be able to ensure that your employees act in conformance with rules and regulations.
Through a comprehensive approach to personnel compliance, you will be able to bring about conditions to prevent crisis situations and conflicts that can result from violations before they happen. If such situations occur, you will be able to evaluate correctly the criminal issues involved, in cases of corruption for example, and to identify the risks involved in relation to criminal and labour law. You will be able to respond to personnel conflicts appropriately, and to contribute to solve them using instruments such as mediation.

Duration:
- 4 months
- The period of supervised study can be extended by four months without additional fees.
Prerequisites:
- A first academic degree and at least two years’ pertinent work experience,
or - Equivalent qualifications:
Secondary leaving certificate with qualification for higher education, completed vocational training and at least five years’ pertinent work experience with supervisory duties, or - Equivalent qualifications:
Completed vocational training and at least seven years’ pertinent work experience with supervisory duties.
We recommend work experience and current employment as a prerequisite for this certificate programme. This ensures that you can directly transfer the skills you acquire to your professional practice.
Credit:
Your achievement in the Personnel Compliance certificate programme can be counted towards the master’s degree course in Compliance at DUW if you fulfil the admission requirements for that course.

Course Content
The certificate programme in Personnel Compliance deals with the requirements of a personnel management system that is oriented towards sustainable, effective compliance.
Foremost are the ethical principles of personnel management, which are the standard by which the actions of those responsible for personnel are measured. Building on this foundation, an overview of the legal system of compliance presents the general context in which the labour law issues involved in compliance are embedded. The programme also examines the main problems that arise in connection with criminal law. Special emphasis is placed on those provisions of the criminal code that affect labour law, and specifically as they relate to typical compliance situations. Potential solutions of personnel conflicts are presented, including in particular the instruments and techniques of mediation.
